The police, national guard and ATF confiscated legal and illegal firearms from ordinary citizens after the storm. Some were taken directly from the citizens other were collected when authorities searched houses. Eddie Compass was filmed on ABC TV saying "No one will be able to be armed. We will take all weapons."   ABC News reported the story (click for video)

Designed to enhance public safety this practice triggered a firestorm of debate:
  • At first the police declined to return the confiscated arms
  • The NRA and Second Amendment Foundation get all exercised and file a lawsuit
  • The police cut a deal to return the weapons if the lawsuit is dropped
  • The legislature passes a law to specifically forbid such confiscations in the future (it is law now, it was law before under the US Constitution)
  • The police begin to return weapons in April 2006 if the citizen can produce proof of ownership and pass a background test (this is illegal and will result in more lawsuits)

August 16, 2006 - Federal District Court Judge Barbier rejected the city's motion to dismiss a lawsuit against Nagin and Riley over the confiscation of the guns.

February 14, 2007 - Judge Barbier fines the city for acting in a wholly unprofessional manner for failure to provide court ordered information to the plaintiffs. Joe DeRosa is representing the city and admitted he was in error in not providing the information. The judge fined the city the cost of the plaintiffs filing. Nagin and Riley are named defendants.  Riley says NOPD did not disarm any citizens who were in legal possession of those weapons. Nearly 900 of the 1,000 guns confiscated (illegally) after the storm are sitting in the police property room in a storage container. The city refuses to return them to their owners, even if those owners pass a background check and are able to describe the weapon.
